NRDC, Coalition Ask Court to Block EPA’s Dirty Energy Plan

lWASHINGTON  – A coalition of environmental and public health groups, including the Natural Resources Defense Council, today urged the U.S. Court of Appeals here to vacate the Environmental Protection Agency’s “unlawful replacement” for the Obama-era Clean Power Plan.

The brief against EPA’s disingenuously named “Affordable Clean Energy” rule asks the court to require the agency to establish genuine protections against carbon pollution from existing power plants.

The following is a statement from David Doniger, senior strategic director of NRDC’s Climate and Clean Energy Program.

“Escalating an all-out assault on clean air is especially dangerous amid this global pandemic. We’re counting on the courts to protect vulnerable Americans instead of big polluters.”

Other parties joining in the brief are the Environmental Defense Fund, the Clean Air Task Force, the Sierra Club, as well as the American Lung Association, the American Public Health Association, the Appalachian Mountain Club, the Chesapeake Bay Foundation, the Center for Biological Diversity, the Clean Air Council, Clean Wisconsin, the Conservation Law Foundation, the Environmental Law & Policy Center and the Minnesota Center for Environmental Advocacy. 

States, cities, power companies, and clean energy associations also filed briefs today seeking similar relief.
